**Effective Date:** May 13, 2026 These User Terms and Conditions ("Terms") govern your access to and use of BMapi services, websites, applications, APIs, dashboards, integrations, and related technologies ("Services"). By accessing or using any BMapi service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not access or use our services. --- ### 1. About BMapi BMapi provides WhatsApp Business API solutions, communication services, automation systems, integrations, dashboards, and related business messaging technologies. Our services may integrate with third-party platforms including Meta Platforms and WhatsApp Business Platform. --- ### 2. Eligibility By using our services, you confirm that: * You are legally capable of entering into binding agreements * You are at least 18 years old * You will use the services only for lawful business purposes * All information provided by you is accurate and complete BMapi reserves the right to suspend or terminate access if false or misleading information is provided. --- ### 3. Account Responsibilities Users are responsible for: * Maintaining the confidentiality of account credentials * Restricting unauthorized access to their accounts * Ensuring all activities under their account comply with applicable laws and policies * Immediately notifying BMapi of unauthorized access or security concerns You are fully responsible for activities performed using your account or API credentials. --- ### 4. Acceptable Use Policy Users agree not to: * Send spam, unsolicited, abusive, fraudulent, or misleading messages * Violate Meta or WhatsApp policies * Use the services for illegal activities * Attempt unauthorized access to systems or data * Distribute malware, harmful code, or phishing content * Infringe intellectual property or privacy rights * Use services in a way that disrupts platform stability or security Violation of this policy may result in immediate suspension or termination without prior notice. --- ### 5. WhatsApp Business Platform Compliance Users utilizing WhatsApp Business API services must comply with: * WhatsApp Business Messaging Policy * Meta Platform Terms * Applicable communication and data protection laws Users are solely responsible for: * Obtaining proper customer consent before messaging * Maintaining lawful communication practices * Ensuring message content complies with applicable regulations BMapi is not responsible for account restrictions, quality rating reductions, bans, or enforcement actions taken by Meta or WhatsApp. --- ### 6. Payments and Billing Users agree to pay all applicable: * Subscription fees * Messaging charges * Setup fees * Service renewal fees * Taxes and applicable government charges Failure to complete payments may result in: * Service interruption * Suspension of accounts * Removal of access to APIs or dashboards Unless otherwise stated in writing: * All payments are non-refundable * Setup and onboarding fees are non-refundable after activation --- ### 7. Refund and Cancellation Due to external setup, onboarding, verification, and infrastructure costs associated with WhatsApp Business API services, payments are generally non-refundable once services have been activated. Users may request cancellation of services at any time. Cancellation will stop future billing cycles where applicable but will not automatically result in refunds for previously paid amounts. --- ### 8. Privacy and Data Protection BMapi processes information in accordance with its Privacy Policy. By using our services, you acknowledge and agree that: * Data may be processed through Meta and WhatsApp infrastructure * You are responsible for obtaining required permissions from your users or customers * You will not misuse or unlawfully process personal data Users remain solely responsible for the legality of customer data collected and communications sent through the platform. --- ### 9. Third-Party Services Our services may rely on third-party providers including: * Meta Platforms * WhatsApp Business Platform * Cloud hosting providers * Payment processors * Analytics services Availability and functionality of services may depend on these third-party systems. BMapi is not responsible for outages, restrictions, delays, or changes caused by third-party providers. --- ### 10. Intellectual Property All software, APIs, dashboards, branding, systems, content, and technologies provided by BMapi remain the property of BMapi or its licensors. Users may not: * Reverse engineer systems * Copy or reproduce proprietary software * Resell services without authorization * Use BMapi branding without written permission --- ### 11. Service Availability BMapi aims to provide stable and reliable services but does not guarantee uninterrupted or error-free operation. Services may be affected by: * Maintenance activities * Meta or WhatsApp outages * Infrastructure issues * Government restrictions * Technical failures * Third-party provider disruptions We reserve the right to modify, suspend, or discontinue services at any time without liability. --- ### 12. Limitation of Liability To the maximum extent permitted by law, BMapi shall not be liable for: * Indirect or consequential damages * Data loss * Revenue loss * Business interruption * Messaging delays or failures * Account bans or restrictions by Meta/WhatsApp * Unauthorized access caused by user negligence Use of the services is at your own risk. --- ### 13. Indemnification You agree to defend, indemnify, and hold harmless BMapi and its affiliates, employees, partners, and service providers from any claims, damages, liabilities, or expenses arising from: * Your misuse of services * Violation of laws or platform policies * Unauthorized messaging activities * Customer disputes * Data protection violations * Intellectual property infringement --- ### 14. Suspension and Termination BMapi may suspend or terminate user access immediately if: * These Terms are violated * Fraudulent or abusive activity is detected * Required compliance information is not provided * Payments remain overdue * Meta or WhatsApp policies are violated Termination may result in permanent loss of access to services and associated data. --- ### 15. Changes to Terms BMapi reserves the right to update or modify these Terms at any time. Updated versions will be published on our website. Continued use of services after changes constitutes acceptance of the revised Terms. --- ### 16. Governing Law These Terms shall be governed and interpreted in accordance with applicable laws and regulations of the relevant jurisdiction. Any disputes arising under these Terms shall be subject to the jurisdiction of the competent courts. --- ### 17.
